Terms and Conditions for Chill Innovation
Prices and Payment
Chill Innovation ApS (hereafter Chill) reserves the right to change prices without prior notice. Subject to errors in prices, information, and supplier failures. Webshop orders are not legally binding until manually processed and confirmable by Chill.
Payments are securely processed through Quickpay (Visa/Dankort, Visa, Mastercard, Maestro etc.), alternatively by PayPal or T/T bankwire if applicable.
In case of overdue payments, we reserve the right to debit the amount due by 2% interest per. month and a fee. All goods remain the property of Chill until the full payment including interests and fees are paid.
All items will be shipped from Denmark (EU) unless otherwise noticed. All shipments are subject to the carrier's own terms.
When you create an account in the webshop, the delivery costs are automatically estimated based on quantity, weight, carrier and destination. Chill take reservations for the actual shipping charges and carrier until the order is manually processed.
Refusal of receipt and uncollected packages are subject to the forwarder's return shipping rate plus €20,- in handling costs. You can not exercise the Return Policy automatically by not receiving/picking up packages!
Chill offer a 20 day return policy on consumer e-commerce purchases (B2C) within EU. No return policy for B2B purchases. There are no returns and replacement offered for procure goods, customized products and consumables etc.
Prior written notice must be given if you wish to use the return policy. Subsequently, relevant return instructions are received per. email. Items returned to Chill without prior agreement, by Cash on Delivery (COD) or recklessly shipped will not be accepted.
Items must be returned in complete and full salable condition, in undamaged original packaging and at your own risk and expense. The customer pays for any impairment, estimated by Chill, as a result of usage and returned product condition.
Shipping costs, including the actual shipping value of orders delivered with free shipping, are non-refundable.
We accept partial withdrawal of purchase, but delivery costs are not refundable. If the total purchase amount is below any free-freight limit, the actual delivery costs will be deducted from the refund.
Processing time usually takes 1-5 working days and refunds will be returned to same card used for the initial purchase.
Warranty & RMA
Products are covered by a 2 year limited warranty from date of invoice unless otherwise stated.
Complaints regarding defects must be notified in writing to Chill within 8 days after the date on which you have or should have discovered the defect. Subsequently, relevant return instructions are received by e-mail.
Some products comes with a direct manufacturer or service company specific guarantee, warranty or services. Upon delivery these rights are transferred to the customer and may not be applicable to Chill. Batteries, including PowerBanks, are consumables with limited lifetime dependant on operating conditions. The warranty only cover production related defects.
Items returned to Chill without prior agreement, by Cash on Delivery (COD) or recklessly packaged will not be processed. Alternatively, returned at your expense and risk, or discarded after one month.
All items must be returned to Chill complete, in undamaged original packaging, securely wrapped and at your own risk and expense. The packaging should always be kept by the customer during the entire warranty period.
A detailed error description and a copy of the invoice should always be submitted. Chill reserves the right to credit the item at its original price, not exceeding the current replacement price. Chill reserves the right to refuse crediting customary items.
Chill offers no warranty on software of any kind. If the operating system and/or other software cause operational problems, the buyer must expect to pay for repairs.
In the case of returns, where no problems are detected according to the error description, Chill reserves the right to charge you an technician inspection fee and return shipping costs.
When we offer repair or equivalent product replacement, you are not entitled to cancel the transaction or to claim any further compensation. Chill is not responsible for any delay caused by remedy or replacement.
Chill disclaims liability of any nature including loss of data. To the extent Chill is held responsible to you, the liability is limited to direct damages and excludes damage to connected equipment, and indirect losses as lost profits, business interruption, installation costs, etc. Chill assumes no liability as a result of your relationship to a third party.
In case you want to complain, and we fail to find a common solution together, EU residents can file a complaint via the EU Commission's online complaint portal http://ec.europa.eu/odr, if the conditions for this are met. When filing a complaint use our email address firstname.lastname@example.org
Buyer can not require mother language translations of manuals, packaging texts, product sheets, product specifications, software etc. Chill can not be held responsible for discrepancies in any information from the manufacturers of the goods or service companies for services rendered.
All orders are subject to force majeure, including war, civil unrest, natural disasters, strikes and lockouts, failing supplies of raw materials, fire, damage to Chill or suppliers production facilities, lack of transportation, import or export conditions and any other event which prevents / restricts us to deliver. Chill has the choice to cancel the transaction, raising a portion of it, or to deliver as soon as the impediment to normal delivery is canceled. We will indemnify us for any losses you may suffer as a result of the non-delivery.
Any deviation from the terms of trade can only occur after written permission from Chill Innovation.
